ARTICLE 1 : Scope

these terms and conditions  (hereinafter “T&C”) rule over the main object of the companyIKONE WEB - ONE HOUR (hereinafter ONE HOUR) with a capital of 10,000 euros with a registered office at 24 rue Emile Lepeu and active in their location at 24 rue Emile Lepeu (75011) Paris France and 23 rue Servan (75011) Paris France as set in article 2 (two) of the T&C.

These T&C are intended for any person (natural or social) that wish to buy any object or service on the website http://www.one-hour.fr (hereinafter the USER) and set the legal conditions that are applicable to any booking  done through this website. 

ARTICLE 2 – MAIN ACTIVITY OF THE COMPANY

One Hour is an escape game live size owned by the company IKONE WEB-ONE HOUR and undertake the organisation and selling of riddle games with 2 to 5 person groups. 

ARTICLE 3 : BOOKING - ROOM RESERVATION

Access to ONE HOUR equipment and services is only granted once the USER made a booking on the website http://www.one-hour.fr (hereinafter the WEBSITE)

The booking is made for a specific day and time, it is only valid for this specific time. 

The booking is only available for a limited number of slots shown in real time onto the WEBSITE

The booking will be finalised only upon receipt by the USER of an confirmation email from ONE HOUR. 

ARTICLE 4 – PROVISIONING AND USING THE ROOM

Under the very principle of the game, ONE HOUR gives the USER the right to occupy an organised ensemble of rooms customised in order to partake in a riddle game in group (hereinafter the ROOM) for a mexed duration of sixty (60) minutes (hereinafter the DURATION). The occupation of the ROOM is only done in order to partake in a game organised by ONE HOUR, which has to be completed by a 2 to 5 people teams. 

The USER accept that the time spent in the ROOM cannot exceed the DURATION first set in the booking, that whether they fulfilled and completed all the content of the ROOM or not. This is part of the very essence of the game. In addition, USERS understands that the game might en before the end of the DURATION given that thy completed all the content of the ROOM ; such an end will give no adjusting or compensation of any kind. 

Access to the ROOM is only possible by showing the confirmation email for the said booking (send to the USER on the latest 12 hours after PAYMENT as defined in article 6 of the T&C) with a presentation of a proof of identity. 

The complexity of the game does not allow any USERS to be under 12 years old. Underage USERS under 15 years old have to be accompanied by an adult. Underage minor over 15 years old may be unaccompanied. in case of a doubt concerning a USER age, ONE HOUR has the right to ask for proof of age. 

USERS are held to keep the ROOM and all equipments (including but not limited to decoration, fourniture etc…) in a working state and use it following the rules and recommendation made by ONE HOUR. Therefore the USER can be held accountable for any voluntary damage or caused by a use of the room and its equipment unauthorised or in opposition with the common use will be subjected to a chargeback for which the value shall be evaluated by ONE HOUR in accordance with the mending costs. 

In addition the USER is expected to to use the ROOM and its wares in order to cause or risking causing harm to any other USER. 

During the whole time spent on the site of ONE HOUR, the USER undertake to behave respectfully, to bend to the rules and work with ONE HOUR staff. Therefore, ONE HOUR shall not tolerate any for of violence, verbal or physical and under any form upon its employee. And has the right to expel any person whose behaviour shall come close to any of the above mentioned behaviour. 

ONE HOUR also has the right to refuse access to any person under the influence of either drug or alcohol of any kind this in order to prevent any harm to come to this person or any of his or her entourage. .

Because of the secret nature of the game, no recording of any kind can be made at the site of ONE HOUR. Therefore any use of vidéo or sound recording (including but not limited to mobile phone, camera, Go Pro) is strictly prohibited within ONE HOUR site. Any use of such devices can result in the cancelling of the game for the whole team.

any and all measures taken under this article conditions and enunciated situations gives no right to any remedy or refund for cancelling interrupting to refusing access to the ROOM. 

ONE HOUR count on the discretion of the USERS concerning the details of the game directly or indirectly. Any divulgation even of part of a game would be injurious ot ONE HOUR who would expect a remedy from the USER amounting to this damage. 

ARTICLE 5 – PRICE AND PAYMENT

The prices indicated by ONE HOUR are in Euros including tax and including also the Added Value Tax, applicable on the day of booking. any change made on this tax shall impact the services prices. 

Completing the payment procedure online on the WEBSITE (hereinafter the PAYMENT) gives right to a booking of a ROOM for the DURATION and scenario chosen (hereinafter SESSION)

Prices made by ONE HOUR are indicated on the WEBSITE that present the PAYMENT. 

The SESSION price depends on the number of player that participate. 

Days : before 6pm working days  (outside french school holidays) 

• 2 players: 88€ – 44€/players
• 3 players: 96€ – 32€/players
• 4 players: 104€ – 26€/players
• 5 players: 110€ – 22€/players

days  : from 6 to 10pm working days, sunday and French school holidays

• 2 players: 96€ – 48€/players
• 3 players: 108€ – 36€/players
• 4 players: 120€ – 30€/players
• 5 players: 130€ – 26€/players

Days : 8pm working days and saturday

• 2 players: 100€ – 50€/players
• 3 players: 114€ – 38€/players
• 4 players: 128€ – 32€/players
• 5 players: 140€ – 28€/players

ONE HOUR has the right to modify their price at any given time. any USER will pay the price according to the pricing on th day of the booking. 

neither the USER or ONE HOUR has any right to the cancelling of the booking one-sidedly. However ONE HOUR has the right in case of a situation of Force Majeure as defined by the French Civil Code or French precedents, to cancel the booking upon the refund of the initial sum paid for the booking. 

Any other services, such as the ROOM adaptation to the USER (hereinafter the CUSTOMISATION), will give additional billing. 

the CUSTOMISATION of the room VERY BAD NIGHT is subjected to the receipt by ONE HOUR of elements sent by the USER. the list of these elements is to be transmitted to the USER via email. Without communication of these elements at least three (3) calendar days before the day of the SESSION, ONE HOUR has the right not to implement the CUSTOMISATION without any refund or financial compensation of any kind. 

A booking cannot be transferred or resold on commercial purposes. If such a case happens, the holder will see his access denied. 

the time of the SESSION shall be reminded in every and all confirmation emails sent by ONE HOUR. in case the USERS is late for the booked SESSION the USERS can choose whether or not to start the game, given that the ROOM shall be freed by the end of the DURATION of the initial booking. ONE HOUR has the right to refuse any USER whom delay is over twenty (20) minutes. 

If less USERS arrive for the SESSION than was initially booked the USERS have the right to a compensation through a gift card usable with posterior SESSION at ONE HOUR of an equal value to the difference. 

If more USERS arrives for the SESSION than was initially agreed in the reservation , the difference in price is to be settled before the game and in the limit of the five (5) players max set for a ROOM. 

ONE HOUR have the right to refuse any booking to a USER that haven’t paid any and all element duly billed to them. 

For the gift card, in accordance with  the article L 121-21 of the French Code of Consumption, in case of a distance selling, the USER has 2 weeks to retract. if the gift card has not be used by that time or if the beneficiary of the said card without cause to be notified nor penalties, all expenses will have to be set on the USER. 

the beneficiary of the gift card inform ONE HOUR of his or her decision of retracting by addressing a Written letter before expiration of the delay set down in article L121-21 of French Commercial Code. 

Postponing the Session is possible upon seven (7) calendar days before the initial date of the SESSION by addressing an email to ONE HOUR through the address : contact@one-hour.fr.

ARTICLE 6 – PERSONAL DATA

The USER is responsible with the accuracy of the information given in the booking forms on the WEBSITE. 

the definition of the following terms starting with a capital and not defined in the T&C shall be interpreted in application of the General Data Protection Regulation (UE) 2016/679 and its French application adaptation

The Controller is ONE HOUR

the Purpose of the Process are : 

• customer success
• booking completion
• newsletter

The process only include only Name, Surname, email address and phone number of the data subject whom gave the information him/herself. 

ONE HOUR shall not tranfer any data to its commercial partners

ONE HOUR shall store the data on private servers which access is secured. 

It is reminded that all person has the right to access modify, deletion, limitation portability and opposition. and a right to reclamation to the right authority.

ARTICLE 7 – SECURITY

The USER undertake to follow any and all the security measures given at the beginning of the SESSION, whether they are according to contract, held on the site or given orally by ONE HOUR staff. 

it is strictly forbidden to smoke within the site of ONE HOUR and in the ROOMS

all USERS undertake to take note and respect the security measures and emergency procedures set in the site of ONE HOUR, as well as the emergency exit. these are clearly identified at the sit. Hence it is strictly forbidden to hinder or else block theses exit that shall remain free at all time. 

the USER can use the emergency exit only in case of the evacuation of the site (in case of fire for example). any abuse or unjustified use of these exit by on or several USERS shall be billed to them by ONE HOUR who will evaluate the damages caused by such an abuse. 

ARTICLE 8 – PHOTOS ET CAMÉRAS

Photos of each team of USERS can be taken before or after the SESSION. these photos shall be used by ONE HOUR as a promotional content via the WEBSITE or any social networks. these photos will also be sent by email to the USERS after the SESSION. 

ONE HOUR shall not be held accountable for any used made of these photos by the USERS

Every ROOM is equipped with CCTV cameras that record in video and sound to follow and help the USERS during the SESSION if needed. These devices shall not save any of these files, leaving no trace on the SESSION or the USERS. 

ARTICLE 9 – INTELLECTUAL PROPERTY

Any and all of the elements, text, hollows, images of the WEBSITE is ONE HOUR exclusive intellectual property. 

In addition, any and all riddles, clues and styles of the ROOMS are exclusive and complete intellectual property of ONE HOUR. 

Any copy is strictly forbidden.

ARTICLE 10 – APPLICABLE LAW AND COURT

the T&C are subjected to the French law and Paris Tribunal de Commerce shall be the only relevant court onto this subject matter. 

in accordance with the ordonnance n°2015-1033 of the 20th of august 2015 and its application decree, any and all contention or litigation concerning a consumer can be subjected to a mediation by MTV Travel. 

in order to reach such a solution you can either :

whatever the means used in order to sease MTV Travel, your demand has to  contend the following information : your postal information, email and phone number. information about ONE HOUR, a summary of the facts, and the proof that first demands had been made to ONE HOUR.
